Terms of Service

Welcome to Fitobie! These Terms of Service ("Terms") govern your use of the Fitobie platform, including our website, applications, and all related services. By creating an account or using Fitobie, you agree to these Terms.

Fitobie is operated from Boston, Massachusetts. If you have questions, reach us at support@fitobie.com.

1. Eligibility & Access

Fitobie is an invitation-only platform. To create an account, you must receive a valid invitation code from an existing Fitobie user and claim it during registration.

• You must be at least 18 years old, or have verifiable parental or guardian consent, to use the platform.
• Each invitation code may only be claimed once and is tied to the account that redeems it.
• Fitobie reserves the right to revoke access if an invitation was obtained fraudulently.

2. Account Types

Fitobie serves three types of users. Your account type determines which features are available to you.

Customer Customer

• Browse and watch FitCho dance workout videos
• Purchase FitCoins (virtual currency) to register for live workshops
• Unlock step-by-step breakdown clips for individual FitChos
• Write reviews for workshops you've attended
• Save favorite FitChos for easy access

Choreographer (Provider) Choreographer

• Upload original FitCho choreography videos
• Create live workshops — set pricing, capacity, and venue
• Add breakdown clips to your FitChos for purchase by customers
• Earn revenue from workshop registrations and breakdown purchases
• Receive payouts via Stripe Connect after a settlement period

Venue Venue

• List your physical spaces on the platform with photos and details
• Set availability windows and hourly pricing for each space
• Earn flat fees when choreographers book your space for workshops
• Manage bookings through a status lifecycle (pending → confirmed → completed)

You may only hold one account type at a time. Account type is assigned during registration and may be changed only by contacting support.

3. FitCoins (Virtual Currency)

FitCoins are Fitobie's in-platform currency used to register for workshops and unlock breakdown clips.

• Exchange rate: 1 FitCoin = $1.00 USD
• Purchase method: FitCoins are purchased with real money via Stripe
• Expiration: Purchased FitCoins expire 90 days from the date of purchase. Oldest lots are consumed first (FIFO — first in, first out)
• Promotional credits: FitCoins earned through invitation codes or promotions may have a shorter expiration period (typically 30 days)
• Non-transferable: FitCoins cannot be transferred between users
• No cash-out: FitCoins cannot be redeemed for real money, except when Fitobie initiates a refund for a cancelled workshop
• Refunds: If a workshop is cancelled, registered customers automatically receive their FitCoins back as new lots with fresh 90-day expiry

4. Workshops

Workshops are live, in-person dance fitness sessions created by choreographers and hosted at listed venues.

Creating Workshops Choreographer

• Choreographers create workshops by selecting a venue time slot, setting a FitCoin price per customer, and defining capacity
• A minimum registration threshold may be set — if the threshold is not met before the workshop date, the workshop may be auto-cancelled

Registering for Workshops Customer

• Customers register by spending FitCoins equal to the workshop price
• Registration is first-come, first-served up to the capacity limit

Cancellations & Refunds All Users

• If a workshop is cancelled — whether by the choreographer, the venue, or a platform administrator — all registered customers receive automatic FitCoin refunds
• Workshops that fail to meet their minimum registration threshold may be auto-cancelled before the event date

Settlement Choreographer

• Revenue from workshop registrations is held for a settlement window after the workshop is completed
• After the settlement window closes, earnings are available for payout

5. Revenue & Payouts

Revenue Split Choreographer

• Fitobie retains a platform fee from all workshop registration revenue and breakdown clip purchase revenue. The choreographer receives the remainder after the settlement window
• The current revenue split and any applicable fees are displayed in the Choreographer earnings dashboard within the platform
• Fitobie reserves the right to adjust the revenue split percentage with 30 days' written notice to affected choreographers
• Venue flat fees (the cost of the booked space) are deducted from registration revenue before the platform/choreographer split is applied

Payouts Choreographer

• Choreographers must connect a Stripe account via Stripe Connect to receive payouts
• Payouts are processed automatically once the settlement window has closed and the choreographer has a connected Stripe account in good standing

Venue Earnings Venue

• Venues earn a flat fee per workshop booking, based on their published hourly rate and the timeslot duration
• The venue flat fee is earned upon successful completion of the workshop
• If a workshop is cancelled before it takes place, no venue fee is earned

6. Venue Terms

• Venue owners set their own pricing per hour for each listed space
• Bookings are made by choreographers and follow a status lifecycle: pending → confirmed → completed
• Venue owners may cancel a booking — in such cases, all registered customers are automatically refunded
• Venues must ensure listed spaces are accurately described and available during published time slots

7. Content Ownership & License

• Ownership: Choreographers retain full ownership of any FitCho content they upload to the platform, including videos and breakdown clips
• License grant: By uploading content, choreographers grant Fitobie a non-exclusive, royalty-free license to display, stream, reproduce, and promote the content on and through the platform
• No claim: Fitobie does not claim ownership of user-generated content
• Removal: Choreographers may request removal of their content by contacting support. Removal may take up to 7 business days to fully propagate

8. Prohibited Conduct & Security

You agree not to engage in any of the following prohibited activities. Violations may result in immediate account termination, forfeiture of all FitCoins, and legal action.

Hacking & Unauthorized Access

• Attempting to access accounts, data, or systems that do not belong to you
• Exploiting vulnerabilities, bugs, or security flaws in the platform — whether discovered accidentally or through deliberate testing
• Manipulating API calls, database records, or platform functionality in ways not intended by the user interface (including but not limited to: inflating FitCoin balances, modifying transaction records, altering booking statuses, or escalating account privileges)
• Using automated tools, scripts, bots, or crawlers to interact with the platform without written permission from Fitobie
• Intercepting, monitoring, or modifying communications between the platform and its servers

Reverse Engineering

• Decompiling, disassembling, or reverse-engineering any part of the platform's software, APIs, or infrastructure
• Attempting to derive source code, algorithms, data structures, or security mechanisms from the platform
• Circumventing or disabling any security measures, access controls, or digital rights management
• Scraping, harvesting, or bulk-collecting data from the platform (including user information, content metadata, or pricing data)

Fraud & Bad Intent

• Creating multiple accounts to circumvent platform limits, exploit promotional credits, or evade suspension
• Sharing, selling, or distributing invitation codes for profit
• Filing fraudulent chargebacks or payment disputes for legitimately delivered services
• Impersonating another user, choreographer, venue, or Fitobie staff
• Uploading content that infringes on the intellectual property rights of others
• Coordinating with others to manipulate reviews, ratings, or registration counts
• Using the platform to harass, threaten, or harm other users

Consequences

If Fitobie determines — at its sole discretion — that you have engaged in any prohibited conduct:

• Your account will be immediately and permanently terminated
• All remaining FitCoin balance will be forfeited with no refund
• Any pending earnings or payouts will be withheld
• Fitobie reserves the right to pursue legal remedies, including civil damages and referral to law enforcement where applicable
• You agree to indemnify Fitobie for any losses, damages, costs, or expenses (including legal fees) resulting from your prohibited conduct

Responsible Disclosure

If you discover a security vulnerability, we ask that you report it responsibly to support@fitobie.com rather than exploiting it. Good-faith security researchers who report vulnerabilities without causing harm or accessing other users' data will not be subject to account termination.

9. Account Suspension & Termination

Fitobie reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or harms the community.

• Suspended accounts cannot access platform features during suspension
• If a choreographer's account is suspended, their upcoming workshops are cancelled and all registered customers are automatically refunded
• Content belonging to suspended accounts is hidden from public view for the duration of the suspension
• Terminated accounts lose access permanently. Any remaining FitCoin balance is forfeited

10. Privacy & Data

• We collect email addresses for account management, notifications, and support
• Payment processing is handled entirely by Stripe — Fitobie does not store credit card numbers or banking details
• Your chosen nickname is displayed publicly on the platform (in reviews, registrations, etc.). Your email address is never shared with other users
• We may use anonymized, aggregated data to improve the platform

11. Limitation of Liability

The Fitobie platform is provided "as is" without warranties of any kind, whether express or implied.

• Fitobie is not responsible for the quality, accuracy, or safety of workshops, choreography, venue conditions, or any interactions between users
• Fitobie is not liable for injuries, accidents, or damages that occur during workshops or at venue locations
• To the maximum extent permitted by law, Fitobie's total liability to any user is limited to the value of that user's current FitCoin balance at the time of the claim
• Fitobie does not guarantee uninterrupted access to the platform and is not liable for downtime, data loss, or service interruptions

12. Modifications to These Terms

Fitobie may update these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page.

Your continued use of the platform after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with updated Terms, you should discontinue use of the platform.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States of America, without regard to conflict of law principles.

14. Dispute Resolution

If a dispute arises between you and Fitobie:

• Step 1 — Good-faith negotiation: Both parties agree to first attempt to resolve the dispute informally by contacting support@fitobie.com and engaging in good-faith discussion for at least 30 days
• Step 2 — Binding arbitration: If the dispute is not resolved through negotiation, it will be settled by binding arbitration conducted in Boston, Massachusetts, in accordance with applicable arbitration rules
• You agree to resolve disputes on an individual basis and waive any right to participate in a class action
